Ignition Interlock Devices in New Jersey 

On January 15, 2010, New Jersey DWI and Refusal Statutes were revised by a bill sponsored by Senator Jim Whelan nicknamed “Ricci’s Law”. Under N.J.S.A. 39:4-50.16, this law makes it mandatory that an ignition interlock device be installed at the defendant’s expense for a set period of time on all vehicles driven by the defendant under a refusal conviction, repeat DWI-conviction (second or third offenses), and for first offense DWI convictions where the blood alcohol content (BAC) level was .15% or higher (remember the legal limit is .08%). An Ignition Interlock device is a blowing device that attaches to your vehicle or vehicles which tests your BAC level. Further, if your BAC registers a .05% or higher than your vehicle will not start and is not operational. If a proper level is registered the device still requires repeated breath samples every 15 – 30 minutes while in operation. The costs of these ignition interlock devices are approximately $100/month plus installation fees. These devices are expensive and embarrassing if they are installed on your vehicle.

Alcotest 7110 Certified DWI Defense Lawyer in Bergen County, NJ

In New Jersey, the state uses the Alcotest 7110 breath testing device to prosecute DWI cases which is manufactured by Draeger Safety. Travis J. Tormey attended a seminar in 2011 to obtain his Alcotest 7110 certification. The seminar was given to only about 20 lawyers in New Jersey and was conducted by the vice president of Draeger Safety. Mr. Tormey is now trained on the Alcotest 7110 MKIII-C Version NJ3.11’s analytical system, components, and peripherals, as well as how to operate the instrument and perform a New Jersey specific breath test sequence. As such, Mr. Tormey is licensed to operate the breath testing device used in all New Jersey DWI cases and can utilize this expertise to determine the admissibility of the breath test result in your case.
