New Jersey, like many states around the U.S., has established a juvenile court system that focuses on rehabilitation of young offenders rather than punishment. Courts want to reform young offenders and, whenever possible, give them a second chance.
This does not mean that you can take charges faced in juvenile court lightly. Juvenile offenses typically lead to charges being brought in the county where the juvenile resides, rather than where the offense occurred. In appropriate cases, a judge will grant a motion to transfer the case to the county of the juvenile offense. Juvenile trials are heard by a judge without a jury. The rules of trial in juvenile court are different from adult court. At sentencing, the judge has many options that are unavailable to adult defendants. The fact is most juvenile cases are settled without going to trial, but I am always willing to take a case to trial if it’s in the client’s best interest.
