The Drug Court Program in Bergen County Superior Court

The Bergen County Superior Court is one of several counties in New Jersey with a Drug Court program. Drug Court is a program in which the State works with defense attorneys to help non-violent, addicted drug offenders by facilitating their road to recovery, as opposed to imposing a harsher sentence, such as fines and jail time. According to guidelines of the Drug Court Manual, a defendant may be eligible for drug court under N.J.S.A. 2C:35-14 (Special Probation for prison-bound offenders) or N.J.S.A. 2C:45-1 (Ordinary Probation).

Drug Court requires that an offender be employed and under intense supervision, which includes random and frequent drug testing and court appearances. Additionally, a court will impose any counseling and drug treatment programs which they deem most beneficial. The amount of time that the probationary period lasts varies from case to case.

The essential Bergen County Drug Court Program Information is as follows:

  • Bergen County Courthouse: 10 Main Street, Room 134, Hackensack, NJ 07601
  • Drug Court Judge: Eugene Austin, J.S.C.
  • Criminal Division Manager: Alan Quintavella
  • Drug Court Coordinator: Barbara Morgan

Drug Court in New Jersey as a Sentencing Alternative

Drug Court is a valuable alternative program that allows addicts with multiple drug convictions on their record to avoid state prison and receive rehabilitative treatment for their drug issues. The attorneys at The Tormey Law Firm have represented numerous defendants charged with serious drug possession and/or distribution offenses who were facing significant state prison sentences and instead were admitted into the Drug Court Program. Drug Court requires that these individuals maintain employment, avoid any further arrests or convictions, attend drug counseling and treatment facilities, and be subject to random drug testing to ensure that they stay clean during the program. If they fail to comply with these conditions, they are rejected from the Drug Court Program and must serve their previously negotiated state prison sentence. If, however, they complete the program, they are allowed to avoid jail and to overcome their often very serious drug problems. Obviously, this is an extremely beneficial program for the defendant and the State, with the potential to effect significant positive change in the lives of many.
