Waldwick NJ Criminal Offenses

Charges for disorderly persons offenses happen on a regular basis in Waldwick, since this is essentially New Jersey’s version of a criminal misdemeanor. Some of the most common offenses handled in Waldwick Municipal Court include possession of less than 50 grams of marijuana, drug paraphernalia, simple assault, and criminal trespass. For these offenses, you face up to 6 months in the Bergen County Jail and fines not to exceed $1,000. You will also have a charge on your criminal record which will appear on a background check. One level below a DP is a petty disorderly persons offense, such as harassment or disorderly conduct. These are the lowest type of misdemeanor criminal offense possible in New Jersey, but they still carry penalties including up to 30 days in jail and $500 in financial penalties.

Now, of course not all criminal offenses that occur in Waldwick will be handled in the Municipal Court. When the charges are more serious, they will be graded as crimes of the first, second, third, or fourth degree. These are all indictable in nature, which is New Jersey’s version of a felony. When the charges are indictable, they are transferred to the Bergen County Superior Court where the Bergen County Prosecutor’s Office is responsible for prosecuting the case. The degree of the crime also delineates the possible sentencing range, which spans from 18 months to life in prison based on the specific offense in question.

DUI Offenses in Waldwick, New Jersey

Driving under the influence of alcohol or drugs are also offenses for which you can be arrested in Waldwick and throughout Bergen County. New Jersey law makes driving under the influence a significant offense, though it is technically a traffic violation not a crime in the traditional sense. A DWI conviction will not appear on your criminal record, but it may result in heavy fines, suspension of your driver’s license, motor vehicle surcharges for the next several years, insurance spikes, and an ignition interlock device in your vehicle. If you have a prior conviction for drunk driving or more than one, the penalties become increasingly severe.
