Our lawyers recently represented a client in the Fort Lee Municipal Court who was charged with driving while intoxicated (DWI) in violation of N.J.S.A. 39:4-50. This was a first offense DWI for our client who was stopped after allegedly urinating in public and being observed by a law enforcement officer. After the field sobriety tests were conducted, our client was taken to the station to provide a breath sample on the Alcotest 7110 machine. His breath test results were 0.05% BAC, well below the legal limit.
As a result, Mr. Tormey was able to convince the State to dismiss the DWI charge without a trial. Our client pleaded guilty to careless driving and a local ordinance for disorderly conduct and received two (2) points and a fine. His driving privileges were not suspended. Our client was extremely satisfied with the results and we were very happy to have achieved such a successful resolution.
