Our client was stopped for a moving violation on Route 17 South that nearly resulted in a multi-vehicle accident. Swerving and erratic lane change are what alerted officers to a potential problem. According to the police reports, during the stop, the officer observed indicators of impairment coupled with bloodshot eyes. The officer conducted field sobriety tests to which our client allegedly failed each time. During the Horizontal Gaze Nystagmus Test, our client failed to follow the officer’s finger. In addition, he supposedly showed extreme difficulty keeping his balance during the “Walk and Turn” test and continued to sway during the One Leg Stand test. Finally, the officer conducted a Divided Attention test where our client skipped multiple numbers when counting backwards and even continued counting past the number the officer instructed him to stop counting at. When asked by the officer if he consumed alcohol, our client said no but later admitted to consuming three quarters of a beer at a prior event that evening.
Although our client’s vehicle was searched twice for contraband, each search yielded negative results. The officer believed that our client was unable to safely operate a vehicle. Thus, at this juncture, our client was arrested for DWI based on the totality of the circumstances. When brought back to headquarters and placed on the Alcotest machine, our client’s BAC (Blood Alcohol Content) was 0.00%. At this time, he further submitted to voluntarily providing a urine sample when evaluated by a Drug Recognition Expert. The purpose of collecting a urine specimen is to determine if an individual is under the influence of drugs which would have resulted in his inability to properly operate a vehicle. The urine analysis is also known as immunoassay screening, where the urine is tested for Amphetamines, Barbiturates, Benzodiazepine, Buprenorphine, Cannabinoid, Cocaine, Metabolite, Methadone, Opiates, Oxycodone, Phencyclidine, Tramadol and/or Zolpidem. Despite showing negative results for DWI for our client, the State could have potentially argued for DUI (Driving under the Influence of Drugs). In this instance, however, the State utilized a Drug Recognition Expert Report, which showed that our client was not impaired by any intoxicating substances. His urine drug test came back completely clean for any foreign substances.
