A recent client of The Tormey Law Firm was charged with Possession of Methamphetamine (commonly referred to as “crystal meth”) with Intent to Distribute, a third-degree crime. Our client and a passenger were stopped for a minor traffic offense, and the police conducted a search of his vehicle. As a result of this search, a small quantity of methamphetamine was discovered in the vehicle. Neither our client nor his passenger took ownership of the drugs that were found in the car, so both were charged. The third-degree charges carry a possible jail term of 3-5 years in a New Jersey State Prison, as well as possible fines of up to seventy-five thousand dollars. Additionally, on conviction the court is required to suspend the offender’s driving privileges in New Jersey for a period from six months up to two years.

Based on our review of the State’s evidence, we were able to successfully have the case downgraded from the Superior Court to the local Municipal Court. This means that, the client was no longer facing an indictable (felony) charge and potentially years in state prison. The felony charge was downgraded to a disorderly persons offense (misdemeanor) and sent back to the Hackensack Municipal Court for disposition.

Through careful negotiation with the Hackensack Municipal Prosecutor and a careful evaluation of the case, Mr. Perry was able to successfully convince the prosecutor to dismiss the case against our client. Our client was saved all of the onerous penalties associated with a conviction for a criminal offense including jail time, fines, probation, and suspension of his driver’s license.
