Upper Saddle River Police Arrest Man for Lewdness, Aggravated Assault on a Police Officer

On Wednesday, a Montvale man was arrested and charged with aggravated assault on a police officer.

An Upper Saddle River police officer observed 32-year-old Marty Napoleon committing a lewd act. When the officer approached, Mr. Napoleon attempted to flee. During his attempt to prevent arrest, Mr. Napoleon allegedly assaulted the officer.

A press release of the incident also reported that Mr. Napoleon was found in possession of marijuana.

As a result of the incident, Mr. Napoleon has been charged with a host of criminal offenses, including aggravated assault on a police officer, resisting arrest, obstruction, lewdness, possession of marijuana, and possession of drug paraphernalia.

In New Jersey, aggravated assault on a police officer is governed by N.J.S.A. 2C:12-1(b). According to the statute, a simple assault charge, which is ordinarily a disorderly persons offense, can be elevated to third degree aggravated assault when committed against a police officer. If convicted of this charge, Mr. Napoleon could be looking at up to five (5) years in New Jersey State Prison.

According to police, this was not Mr. Napoleon’s first run-in with the law. He has been arrested twice in the past four (4) months for lewdness.

After being arrested this time, Mr. Napoleon was transported to the Bergen County Jail, where he was being held in lieu of $25,000.00 bail.
