Travis J. Tormey recently represented a client who was charged with several criminal offenses, which arose during a Jets game at Metlife Stadium. The client was a fan who went onto the field after the game and took one of the towels out of the bin without permission. Our client had no prior record and, in fact, she had a field pass to go onto the field after the game. However, she was so excited that she “jumped the gun” and went on the field early without proper permission.

She was charged with disorderly conduct, defiant trespassing, and a local ordinance violation for creating a disturbance at the stadium.

Defiant Trespassing – NJSA 2C:18-3

The NJ law that governs trespassing charges in NJ is NJSA 2C:18-3 which provides in pertinent part:

2C:18-3 Unlicensed entry of structures; defiant trespasser; peering into dwelling places; defenses.

b. Defiant trespasser. A person commits a petty disorderly persons offense if, knowing that he is not licensed or privileged to do so, he enters or remains in any place as to which notice against trespass is given by:

(1) Actual communication to the actor; or

(2) Posting in a manner prescribed by law or reasonably likely to come to the attention of intruders; or

(3) Fencing or other enclosure manifestly designed to exclude intruders.

Penalties for a Petty Disorderly Persons Offenses

The client was facing a number of penalties associated with trespassing and disorderly conduct which are petty disorderly persons offense which include the following penalties on each charge:

  • $500 fine
  • Thirty (30) days in Bergen County Jail
  • Probation
  • Permanent criminal charge on their record

Negotiate Plea Agreement with Prosecutor – No Jail Time or Criminal Record

After reviewing the evidence in the case and discussing all potential options, Mr. Tormey was able to negotiate a plea agreement with the prosecutor which allowed both criminal charges (known as disorderly persons offenses) to be dropped. The client plead guilty to the local ordinance violation and received a small fine. She will have no criminal record from this unfortunate incident.
