PTI Violation Lawyer Morris County NJRecently, Travis J. Tormey represented a client at a PTI termination hearing in the Morris County Superior Court in Morristown, New Jersey. She was admitted into the Pre-Trial Intervention (PTI) program based on a credit card fraud charge for allegedly defrauding her employer out of approximately $40,000.00. She had no prior record and was enrolled in the PTI Program for a three-year term, conditioned on her paying full restitution and paying a large amount of the restitution upfront upon her admission into the PTI program. Unfortunately, the check that she provided to probation to pay restitution bounced. As a result, she was scheduled for a PTI termination hearing, where she faced a third degree charge and potential state prison time. The assistant prosecutor also considered charging her with third degree check fraud for bouncing a check on the probation department. If the prosecutor did this, she would then be facing two (2) felony charges (the original credit card fraud charge and the new check fraud charge) and would surely be sentenced to serious prison time.

Fortunately for the defendant, Mr. Tormey was able to convince the prosecutor to allow his client to complete PTI if she paid the restitution in full. Mr. Tormey also persuaded the prosecutor not to file new charges for check fraud. Additionally, Mr. Tormey asked the judge and the prosecutor to give the defendant an additional six (6) months to pay the restitution because her husband was retiring and he would be able to retrieve the money from his retirement account. The defendant provided a certified bank check for the outstanding restitution amount and she successfully completed the PTI program. As a result, she has no record and remained out of prison. This was a major success for the Tormey Law Firm and a massive relief for our client.
