We recently represented a client in the Parsippany Municipal Court who was charged with simple assault under N.J.S.A. 2C:12-1(A). This is a disorderly persons offense in New Jersey (which is similar to a misdemeanor in other states). It is punishable by a $1,000 fine, up to six (6) months in the county jail, and a permanent criminal charge on your record if you are convicted. This conviction can be expunged in certain cases after five (5) years.

In this case, our client had no prior record and was staying at the Parsippany Hilton in order to attend a funeral. He was awakened by a group of teenagers who were banging on all the hotel doors and running up and down the halls of the hotel screaming in the middle of the night. Our client asked them several times to cease this conduct and eventually pushed several of the young men in an attempt to reprimand them. Someone called the police and our client was charged with simple assault for this alleged conduct.

Mr. Tormey, after being hired to handle the case, threatened to file disorderly conduct charges against the juveniles involved. Instead, the State agreed to drop the simple assault charges against our client. Our client is now in the process of expunging his record and, once this expungement goes through, he will not only have no criminal record but the arrest record will also be removed from his criminal history. This was a very satisfying result for our client and the law firm.
