Travis J. Tormey represented a client in the Bergen County Superior Court in Hackensack, New Jersey who was charged with possession of an illegal firearm, possession of a controlled dangerous substance (in this case prescription drugs), and conspiracy. Our client was a resident of New Hampshire with no prior criminal record.
First, our client’s parents hired us to get him out of jail. He was being held on a $100,000 bail with no ten percent option. The Tormey Law Firm filed a bail reduction motion and convinced the judge to lower the bail to $65,000 with a ten percent option. This allowed his parents to post the 10% with the court and he was released from jail.
The facts of the case were as follows: Our client and his girlfriend allegedly drove down from New Hampshire to New Jersey in order to trade a firearm for a number of prescription pills. This transaction was to occur at a rest stop on the parkway but the police intervened. Our client’s girlfriend was the mastermind of the conspiracy and our client was essentially just the driver of the vehicle. The co-defendant agreed to take responsibility for the firearm and for her role in the crime. As a result, she received a five (5) year state prison sentence, one year to be served without the possibility of parole. In exchange, our client received a two (2) year probationary sentence and only plead guilty to a fourth degree conspiracy charge. Considering the potential penalties that our client was initially facing, this was a fantastic result for our client and the law firm.
