Our firm was referred this case by a prosecutor in Passaic County who recommended to the clients that they hire our firm to defend them against these criminal charges. The circumstances of these charges were very unusual. Our clients were a mother and son from Bergen County who had lost another member of their family (their son and brother, respectively) to a heroin overdose in the last few years. The deceased had been sold heroin by a well-known drug dealer from Bergen County who is now being prosecuted for those drug sales as well as for the drug induced death of the deceased young man. This case has been pending at the Superior Court in Bergen County for over a year now. So, essentially, our clients are the victims of the drug dealer who sold the drugs that killed their son and brother. Now, during one of the court proceedings in Bergen County, our clients had a verbal altercation with the drug dealer’s family where certain names were called and alleged threats were made. The drug dealer’s family members turned around and filed charges against our client’s for harassment and terroristic threats.

The terroristic threats charge, a felony, was quickly reviewed by the Bergen County Prosecutor’s office and downgraded back to Municipal Court as a disorderly persons offense. Then, we appeared in Municipal Court and negotiated a plea agreement with the Hackensack Municipal Prosecutor. The mother’s harassment charge was dismissed completely and the son’s harassment charge (which had been downgraded from a felony terroristic threats offense) was amended to a local ordinance violation which resulted in a fine and no criminal record. The drug dealer’s family members objected to this plea arrangement but the Judge and prosecutor disregarded that objection and the case was resolved.
